Terms of Service

Welcome to Meku. These Terms of Service ("Terms") form a legally binding agreement between you and Meku ("we," "our," or "us") and govern your access to and use of the Meku mobile application and all related services (collectively, the "Service"). Meku is built for street dance lovers, combining video sharing, official course videos, themed challenges, personalized dance preferences, and practice time tracking. By downloading, installing, or using Meku, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Acceptance of Terms

By creating an account, signing in, or otherwise accessing or using Meku, you accept these Terms in full. These Terms incorporate by reference our Privacy Policy and any in-app community guidelines. In the event of conflict, these Terms prevail unless a supplementary policy expressly states otherwise.

2. Eligibility

Meku is intended exclusively for users who are at least 18 years of age. By using the Service, you represent and warrant that you meet this age requirement. We may suspend or terminate any account where we reasonably believe the holder does not meet this requirement, without prior notice.

Meku provides direct messaging between users. You agree to use messaging in good faith and in compliance with these Terms. Harassment, threats, doxxing, and unsolicited commercial messaging are strictly prohibited. We may moderate messages reported by users to enforce these Terms.

9. Reporting and Blocking

You can report posts, comments, courses, or users that you believe violate these Terms or our community guidelines using in-app reporting tools, and block users to stop seeing their content or receiving their messages. Submitting false or malicious reports is itself a violation of these Terms and may result in enforcement action against the reporting account.

10. Child Safety and CSAE Policy

Meku has a zero-tolerance policy toward child sexual abuse and exploitation (CSAE), including any child sexual abuse material (CSAM), grooming, or solicitation of minors. Any such content or behavior will result in immediate removal, permanent termination of the responsible account, and reporting to appropriate authorities (such as NCMEC's CyberTipline or the equivalent local authority). To report suspected CSAE, use the in-app reporting feature or email service@meku.cc with subject "CSAE Report."

11. Intellectual Property Rights

Meku and its content (excluding UGC), including the Meku name, logo, app design, software, course materials produced by us or our licensors, and all related intellectual property, are owned by or licensed to us and are protected by applicable intellectual property laws. You are granted a personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works without our prior written permission, except as expressly allowed by law.

Official course videos and related materials are licensed to you for personal, non-commercial viewing within the Service only. You may not download, redistribute, re-upload, resell, or sublicense course content outside the Service.

Practice time and check-in features are provided for personal motivation and informational purposes. Statistics shown in the app are estimates based on in-app activity and should not be relied upon for medical, fitness, or professional purposes. Dancing involves physical activity that carries inherent risks. You are responsible for warming up properly, knowing your physical limits, and consulting a qualified professional if you have any health concern. Meku is not responsible for any injury or harm resulting from your participation in dance activities.

15. Content Moderation and Enforcement

We reserve the right, but not the obligation, to review, moderate, edit, refuse to publish, or remove any content from the Service at our discretion, using automated tools, human reviewers, or both. Enforcement actions may include warnings, removal of content, temporary suspension, or permanent termination of your account, proportionate to the nature and severity of the violation. CSAE, CSAM, and other severe illegal content will result in immediate permanent termination and may be reported to law enforcement.

16. Termination

You may stop using Meku at any time and may delete your account from Settings > Account > Delete Account. We may suspend or terminate your account if you violate these Terms or pose a risk to the platform or its users. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including UGC license, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) shall survive.

17. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that any content or course material will meet your needs or expectations. Use of the Service is at your own risk.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Meku and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, goodwill, or service interruption, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the greater of (a) the total amount you paid to us in the twelve months preceding the claim, or (b) USD $50.

You agree to defend, indemnify, and hold harmless Meku and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) your violation of any applicable law.

20. Third-Party Services

Meku integrates with third-party services, including Apple (Sign in with Apple, In-App Purchase, App Tracking Transparency) and cloud infrastructure providers. Your use of those services is also subject to their own terms and privacy policies. Meku is not responsible for the practices of third parties.

21. Platform Store Terms

Your use of the Meku application downloaded from the Apple App Store is also subject to Apple's App Store Terms of Service. In the event of any conflict between these Terms and Apple's App Store Terms with respect to your use of the application on iOS, Apple's App Store Terms shall prevail to the extent of the conflict.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, our practices, or applicable law. When we make material changes, we will notify you in the app or by other appropriate means. Your continued use of Meku after the revised Terms take effect constitutes acceptance. If you do not agree, you must stop using the Service and may delete your account.

23. Governing Law and Dispute Resolution

These Terms are governed by applicable international consumer-protection law and the laws of the jurisdiction in which Meku is established, without regard to conflict-of-law rules, except where mandatory local laws in your country of residence apply. Before initiating any formal proceedings, you agree to first contact us at service@meku.cc and attempt to resolve the dispute informally. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer under your local law.

24. User Rights and Complaints

You may contact us to report violations, appeal moderation decisions, request access to or deletion of your data, or submit any other complaint regarding the Service. We aim to respond within a reasonable timeframe in accordance with applicable law.
